Early-access SaaS terms

1. The agreement

“Provider” means the person or legal entity identified as the Warpix provider in the order form. “Customer” means the customer identified there. “Service” means the hosted Warpix dashboard, feedback widget, APIs, documentation, and founder-assisted support made available under the order form. “Customer Data” means information submitted to or collected through Customer's workspaces, excluding Provider's software, service telemetry, and aggregated or de-identified information that cannot reasonably identify Customer or a person.

The agreement consists of the order form, these terms, the Data Processing Addendum when applicable, and any document expressly incorporated by the order form. No customer workspace should be activated until the order form is complete and accepted by both parties.

2. Early-access service

Provider grants Customer a limited, non-exclusive, non-transferable right during the order term to let its authorized team members use the Service for Customer's internal business purposes and to embed the widget in Customer-controlled applications. Customer may not resell, sublicense, reverse engineer except where law does not permit that restriction, or use the Service to build a competing service.

Warpix is an early-access product. Features, interfaces, limits, and documentation may change. Unless the order form expressly states otherwise, there is no uptime or response-time service level, no 24-hour support commitment, and no automatic customer-notification feature. Provider will use reasonable care to avoid materially reducing the core feedback workflow during the order term.

3. Accounts and authority

Customer must appoint at least one owner, keep membership and contact details current, assign least-privilege roles, and promptly remove access that is no longer authorized. Customer is responsible for activity under its accounts and represents that the person accepting the order form has authority to bind Customer.

Provider may rely on Customer's designated owner and contacts for configuration, support, export, deletion, recovery, and incident decisions after reasonable verification.

4. Customer Data

As between the parties, Customer owns Customer Data. Customer grants Provider and its approved subprocessors a limited right to host, copy, transmit, organize, derive customer-account and feedback aggregates from, display, back up, export, and otherwise process Customer Data only to provide, secure, support, and improve the reliability of the Service, comply with Customer's instructions, and meet legal obligations.

Customer is responsible for the accuracy and lawfulness of Customer Data, its instructions, and the notices, rights, permissions, and lawful basis needed to collect and use information about its team members and end users. Customer must respond to end-user requests and will not instruct Provider to violate law or another person's rights.

Provider does not sell Customer Data, use it for cross-context behavioral advertising, or use identifiable Customer Data to train machine-learning models. Provider may use aggregated or de-identified information that cannot reasonably identify Customer or a person to operate, secure, and understand the Service.

5. Widget and identity security

Customer must configure only the exact application origins that need the widget and promptly remove obsolete origins. The opaque board identifier is intentionally present in browser code, exposes only the intended public feedback surface, and must never be treated as a dashboard credential or signing secret.

If Customer uses trusted identity, Customer must generate Ed25519 assertions on its own server, keep the private key and signing service out of browsers and Warpix, issue fresh assertions with a lifetime of no more than five minutes, and include only identity, revenue, and tag information the current end user is authorized to see about themselves. Customer must rotate a key immediately if compromise is suspected and coordinate normal key changes with Provider because one widget signing key is active at a time.

6. Acceptable use and prohibited data

Customer and its users must not use the Service to break law, violate rights, distribute malware, send spam, evade limits, probe another tenant, disrupt the Service, submit deceptive data, or attempt unauthorized access. Customer must not upload payment-card numbers, account passwords, private signing keys, government identifiers, health or biometric information, criminal-history information, special-category personal data, children's data, or other regulated or unnecessary sensitive data unless the parties first agree in writing to appropriate scope and safeguards.

Provider may investigate suspected misuse and may suspend the minimum affected access where reasonably necessary to protect the Service, another tenant, or a person, or to comply with law. Provider will notify Customer when lawful and practicable and will restore access after the issue is resolved.

7. Confidentiality

Each party will protect non-public information disclosed by the other using at least reasonable care, use it only for the agreement, and disclose it only to people and providers who need it and are bound to confidentiality. These duties do not cover information that is public without breach, already lawfully known, independently developed, or lawfully received without restriction. A legally required disclosure may be made after advance notice where lawful.

8. Privacy, security, and subprocessors

The Privacy Notice explains Warpix's handling of website and service information. The Data Processing Addendum applies when Provider processes personal data for Customer and is incorporated into the agreement by the order form. Customer authorizes the providers on the current Subprocessors list subject to the notice and objection process in the DPA.

Provider will maintain the safeguards described in the DPA and notify Customer without undue delay after becoming aware of a confirmed personal-data breach affecting Customer Data. Customer must promptly report suspected security issues to hello@warpix.io without emailing credentials, private keys, full assertions, or sensitive content.

9. Fees and taxes

Fees, trial or pilot status, payment dates, currency, and taxes apply only as stated in the order form. Warpix does not currently collect payment-card data through the Service. Neither this website nor an early-access application creates a purchase obligation.

10. Support and changes

Unless the order form says otherwise, support is founder-assisted and best effort through hello@warpix.io. Provider may update the Service to fix defects, improve security, or evolve the product. Provider will give reasonable notice of a change that materially removes a core paid capability where practicable.

11. Term, termination, export, and deletion

The term and any renewal are stated in the order form. Either party may terminate for a material breach not cured within a reasonable written cure period, or immediately where the breach cannot be cured, continued service would be unlawful, or a serious security risk requires it. Any convenience termination right must be stated in the order form.

After termination, Customer's access ends and Provider stops ordinary use of retained Customer Data. The order form must state the operator-assisted export scope and format, request window, active-system deletion or de-identification method, completion target, and any retained audit fields. Warpix does not yet offer self-service or a general full-workspace export or purge tool, so Provider must document and rehearse the agreed customer-specific procedure before activation. Narrow security, legal, audit-integrity, and backup exceptions are described in the Privacy Notice and DPA; current backups expire through a 14-day rotation.

12. Intellectual property and feedback

Provider and its licensors retain all rights in the Service, documentation, designs, and improvements, excluding Customer Data. If Customer voluntarily gives Provider a suggestion or evaluation specifically about improving the Service outside Customer's workspace, Provider may use that suggestion to develop or improve the Service without restriction or payment, but will not publicly identify Customer or disclose Customer's confidential information without permission. Customer Data, including feedback collected from Customer's end users through a workspace or widget, is excluded from this feedback license and remains governed by Sections 4 and 8.

13. Disclaimers and commercial risk terms

Except for obligations expressly stated in the agreement, and to the maximum extent permitted by law, the early-access Service is provided “as is” and “as available” without implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. Nothing excludes a warranty or liability that applicable law does not allow the parties to exclude.

The parties must state any liability cap, excluded losses, indemnities, governing law, and venue in the accepted order form. These public terms deliberately do not invent those material choices and do not create a standalone paid-service contract without an order form.

14. General terms

Neither party may assign the agreement without the other's consent, except with substantially all relevant business or assets, provided the assignee accepts the agreement. Neither party is liable for delay caused by events beyond reasonable control, except payment obligations. Failure to enforce a term is not a waiver. If a term is unenforceable, it will be adjusted only as needed and the rest remains effective. The agreement is the parties' entire agreement about the Service and may be amended only in writing, except that Provider may update public operational or privacy details as described in the applicable document.

15. Website use and contact

Visitors must not misuse this website, interfere with it, or submit unlawful or misleading information. Product descriptions, pricing, availability, and timelines outside an accepted order form are informational and may change.
